Important Notice: If you acquire our products for the purposes of a business, you agree that the provisions of the New Zealand Consumer Guarantees Act 1993 do not apply (refer to Clause 8). If you purchase as a consumer, nothing in these terms limits or restricts your rights under New Zealand consumer law.
1. General & Pricing
Currency: All prices quoted on our website or invoice are in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) unless explicitly stated otherwise.
Price Changes: Prices are subject to change without notice prior to order confirmation. Once an order is accepted and paid in full, the price is fixed.
Inclusions: Prices cover the anti-parking device and standard hardware included in the box. Costs related to professional installation, specialized ground anchoring, electrical work, or ongoing maintenance are not included unless specified in writing.
2. Orders & Payments
Order Acceptance: An order is accepted only when payment has been cleared and we issue an order confirmation or invoice.
Payment Terms: Full payment is required prior to dispatch. Payments may be made via credit card, online bank transfer, or other approved payment methods listed at checkout.
3. Delivery & Risk
Delivery: We will use reasonable endeavors to deliver products within stated timeframes. However, delivery dates are estimates and delays may occur due to freight network disruptions.
Risk: Risk of loss or damage to the product passes to you upon delivery to the physical address provided in your order.
Inspection: You must inspect the package upon arrival and notify us within 7 days of delivery if any items are damaged, missing, or incorrect.
4. Installation & Proper Use
Customer Responsibility: It is your responsibility to ensure that the anti-parking device is installed in accordance with the provided user manual and installed on suitable ground surfaces (e.g., solid concrete or asphalt).
Consents & Permits: You are solely responsible for obtaining any required permissions, property owner approvals, local council permits, or body corporate authorizations before installing the device.
Safe Operation: Devices must be operated only for their intended purpose (securing parking spaces). You must not attempt to drive over raised or partially deployed devices.
5. Consumer Guarantees Act 1993 (For Consumer Purchases)
If you are purchasing our products for personal, domestic, or household use:
Our products come with guarantees that cannot be excluded under the New Zealand Consumer Guarantees Act 1993 (CGA).
You are entitled to a repair, replacement, or refund if the product fails to meet guarantees of acceptable quality, fitness for purpose, or matching description.
Where a failure is minor and can be repaired, we reserve the right to repair or replace the product at our discretion. If the failure is substantial, you are entitled to choose a replacement or refund.
6. Returns & “Change of Mind”
Defects: Returns due to manufacturing faults or CGA guarantees are handled under Clause 5.
Change of Mind: We are not legally required to accept returns if you simply change your mind or choose the wrong size/model. Any return for change of mind is at our sole discretion and may incur a restocking fee and return freight costs borne by you.
Condition: Any agreed change of mind return must be unopened, unused, and in its original packaging.
7. Limitation of Liability & Property Damage
To the maximum extent permitted by New Zealand law:
Vehicle & Property Damage: We accept no liability for any damage caused to vehicles, asphalt, concrete, or surrounding property arising from incorrect installation, misuse, driving over active/raised barriers, or failure to maintain the device.
Indirect Loss: We are not liable for any indirect, special, or consequential loss, including loss of business revenue, loss of parking fees, or towing charges.
Cap on Liability: Our total liability for any claim arising out of or in connection with the product supplied shall not exceed the original purchase price paid for the product.
8. Business Purpose Exclusion (B2B Sales)
In terms of Section 43 of the Consumer Guarantees Act 1993 and Section 5C of the Fair Trading Act 1986, where you acquire (or hold yourself out as acquiring) our anti-parking devices for the purposes of a business (e.g., commercial car parks, property management, corporate fleets, or resale):
The provisions of the Consumer Guarantees Act 1993 do not apply to the supply of the goods.
Sections 9, 12A, and 13 of the Fair Trading Act 1986 do not apply to the extent permitted by law.
You agree that it is fair and reasonable for both parties to be bound by this clause.
9. Force Majeure (Events Beyond Control)
We will not be liable for any failure or delay in fulfilling orders or deliveries resulting from acts beyond our reasonable control, including but not limited to severe weather, earthquakes, fires, supply chain bottlenecks, shipping port delays, government restrictions, or pandemics.
10. Governing Law
This agreement and all sales made under it are governed by the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the New Zealand courts for any legal proceedings or disputes.
